Nothing wrong with it really, besides the fact that Ainz and his npcs attacked first, and when the humans respectfully said they were sorry and just wanted to walk away from the tomb, Ainz went on his autistic rant about nazarick and said that they were just going to kill them anyway, forcing the humans to defend themselves, which actually forces the self defense issue to be on the side of the humans.

You need context here, imagine that nazarick is a farm, those people went there to pick fruits because they believed the farm was abandoned, but suddenly the owner, ainz, shows up with his family and ask what the hell they were doing in his land, if the humans had just said sorry and walked away, ainz could still get them fucked in the courtroom for invasion of property and theft, even if it would be really hard making it stick, but the instant Ainz took the first shot against an opponent that was willing to walk away in peace, he became the aggressor and forced the humans to act in self defense.
I mean, just imagine Ainz trying to defend himself in a courtroom:
