Ex is a code clusterfuck and has a very high bandwidth usage, and it also had a lot of problems with people uploading real CP which most people would not be willing to risk if they copied the site. Nyaa on the other hand is a fairly lightweight torrent tracker that doesn't deal with a large amount of data transfer.

The law article is rather vague and doesn't even mention so-called "virtual CP". Just says that anything that has minors (18-) "involved" is forbidden.
That's open for all kinds of interpretations, and the result was that about 10 years ago, a public prosecutor tried to get a guy convicted who was in possession of drawn porn.
But this was overruled in 2012 by the High Court (the highest legal institution in the Netherlands) which said that the porn has to be sufficiently realistic and has to resemble real CP in order to be punishable by law.
A lower court already ruled a year before that hentai/cartoon pron was specifically excluded from the law because anyone can see it isn't realistic and it can't be mistaken for the real thing.
So yes, you could say it's borderline legal considering the present jurisdiction. But with the law itself being so vague, there's no telling what the future will bring.
