I'm not saying it completely makes sense, this could of been done much better but its pretty obvious at the least Hisoka was trying to cheat the system.
also the only character we know who can repeatedly use nen after death is Camilla and thats because her ability is built around it.

The issue is that HxH wants to portray itself as a manga about "rules" when the rules are broken whenever it is convenient for Togashi. There are essentially no rules at all, and Togashi just writes pages of text he will later break for the "big brain audience." He's a terrible writer.
