I still think of English-speaking consumers as a totally separate thing; basically the Japanese produce whatever, and we English-speakers kind of exist like ghosts, with absolutely no impact whatsoever on the Japanese so that they don't try to pander to us. Within that English-speaking ecosystem there's a general inclination to make translations as freely available as possible, although some groups are willing to be motivated by money to produce more (freely available) translations. Where I draw the line myself is when accessing the translation costs money.

Given that the market the new work overlaps with the old work is effectively zero it's no a strong case for the copyright claim.

Taking from unofficial translations opens a legal can of worms that no publisher wants to get into. Fan translations themselves have never been taken to court to determine fair use, so the legal basis of this is faulty. The most that has ever happened was cease and desist letters for distributing image or game files, but companies don't ever go after the translated script.

The author could publish it for free on his own and ask for donations. But donations are unsteady income and you can't live on it. Most people wouldn't even consider donating. And admit it, the threat of something being illegal does make more people pay for something than when it weren't.
Crowd funding is basically the same as donations.

Scanlations are the sole reason we have so many otherwise obscure manga eventually being released officially in English. People read the scanlations. The author gains an English fanbase. Then years later a company releases that same manga in a physical format and people buy it. That's the only way Japanese manga can gain popularity in the west without a preinstalled fanbase.

If Japanese authors want to change this, they should be starting up patreons. Team up with scanlators to release free chapters and gather subscribers.

The usual term for it has always been "private commission", but yeah, most of the time the person commissioning it specifically requests that the translation be publicly released. I believe there have been cases where they have forbidden or delayed a public release though.
