Its more like its not worth it to go pursue legal action against individuals or small groups making pennies off it and the product the make isn't getting widespread attention anyways. And if they do start getting a lot of attention a C&D is usually enough to stop it. Copyright law is mostly useful for preventing smaller groups and individuals from getting their stuff taken and used by larger groups who they don't have the power to compete against or fight in court without copyright law.

And the doujin market and events gets overlooked because they act as a training ground for new writers, artists, etc that the industry hires new talent from.
