The phone was confiscated by police and returned to the accuser's father.
The father testified he doesnt recall receiving it.
The state trooper that claims he did, also did not document the act, he didn't do the paperwork.
The accuser was asked about the phone and pleaded the fifth (probably got rid of it, which is illegal, so he can't admit to that).

Why would he get rid of it is even more speculation though there are only very few reasons why he would.
