>ESN's eight networks are Cars.TV, Comedy.TV, ES.TV, JusticeCentral TV, MyDestination.TV, Pets.TV, Recipe.TV, and The Weather Channel. ESN and the National Association of African American Owned Media have been seeking a $20 billion judgment because of Comcast's refusal to pay for carriage of the channels. Comedian and media mogul Byron Allen founded ESN in 1993 and is the company's chairman and CEO.
I really hope if any of you subscribe to this racist TV network you'll be cancelling your subscription.
They say Comcast wouldn’t carry BET on it cable lineup
Justin Jones
>implying Comcast hasn't always been shit even before they gave a media empire their own broadcasting arm Hooray capitalism!
Liam Gutierrez
Cable services like Comcast operate by bundling hundreds of individual channels together, paying each of the channel owners a fee and reselling the package to consumers.
Comcast refused to buy ESN's networks because aside from The Weather Channel, they average under 20,000 viewers each. This is absolutely atrocious, abysmal, you could easily get 10x as many people watching a decade old Spongebob rerun at 3AM numbers.
Byron Allen has decided that not giving him money in exchange for his channels that nobody watches is a hate crime.
Ah, are they tackling the obvious hiring bias towards a certain group amongst the top positions of media corporations?
Wyatt Reyes
i wonder if refusal to watch BET is racist ?
Hunter Baker
>wwaaaa i didnt get billions of dollars for being black this isnt fair!
Adam Bennett
comcast getting fucked is good but over something like this is not, i guess the only way to screw over a corporation now is to call them racist or sexist
Ryder Rodriguez
The fact that for many years Comcast was lead by all white men was brought up in the suit.
Christopher Richardson
if the case wins they are going to create dozens of new narrocast TV channels and demand cable systems carry them. The gay channel , the feminism channel , the native American channel and of course the Jewish channel.
Levi Parker
>(((white)))
Samuel Fisher
A savy black business owner is taking full advantage of the racially charged political climate in the US by suing a major cable provider. He claims the cable company did not purchase the rights to air his tv channels because of his race. It is only interesting because the supreme court agreed to hear the case, which implies some legal precedent.
It implies a legal precedent depending on a ruling. The only thing established so far is that the "but-for" argument that Comcast used is not a valid defense.
Elijah Bennett
>this Blacks know how to take advantage of muh racism. They use it to get anything, cash, education, and pussy.
Hunter Lopez
what you mean like the already fragmented media landscape where everyone watches extremely narrowly defined media created for youtube or streaming services?
(example: NRA TV. Example: any of an endless list of LGBTV themed shows; conservation shows headed by every individual ethnicity under the sun; alien conspiracy TV shows/networks)
Noah Diaz
>It is only interesting because the supreme court agreed to hear the case, which implies some legal precedent. There is no way they side in favor of ESN. All this will do is set a legal precedent that makes it harder to sue for racism. Which is unironically a good thing.
Jack Hall
No, he means a legal obligation for cable companies to pay billions of dollars in exchange for aforementioned channels
Kayden Sanchez
If they don't want a nigger channel because they no one wants to watch nigger shows and they want to maximize profits is that still counting as racial bias?
Josiah Hughes
If you frame it as such, yes.
Austin Robinson
I want you guys to take in the scope of how bad it is. Look on this chart for Comedy.tv and Justice Central. Hint: You're going to have to do a lot of scrolling.
And the other five channels, aside from Weather? They didn't get enough viewers to make the chart.
All Comcast has to do is point to every single low ratings channels they don't carry and say we have standards. Case closed.
Julian Gomez
HAHA
Henry Thompson
But what about all the low ratings channels they do carry?
Isaac Watson
>blacks
really? Black people are the only people who have even a slim claim to racism.
The real outrage are Asians claiming racism. That is the most laughable shit on earth.
Ryan Collins
See And Comcast is actually in business with Allen - they decided his #74 ranked Weather Channel was worthy of bundling
Michael Morales
This situation is even sillier than that. ESN is not a "black network" like you're thinking of. It's not BET where all of the programming consists of black people and is marketed specifically for black people. It's a network of networks like the Weather Channel, Justice Channel, etc. The suit simply accuses them of not carrying these networks because the owner is black.
James Sanders
If he wins other black people will find a niche, to sue non-niggers everytime they refuse an offer.
Gavin Rogers
They show what they pay for those channels and how many more viewers those channels get. If they paid less for those channels or equal and those channels had more viewers, case closed. Capitalism is not racism.
Michael Mitchell
The Weather Channel was actually purchased by ESN recently, while still under contract with Comcast. That's the only reason it's still being carried.
Jaxon Hall
You can already tell what a high quality network this is. We're missing out, bros.
Holy shit that is absurd. Hopefully Comcast wins and files a lawsuit against the company and bankrupts them. Don't fuck with major corporations, they will take kindly to such things.
Isaiah Adams
>I'M MAD BECAUSE TRUMP DIDN'T STUFF THIS COURT
David Butler
I'm gonna skip ahead of 300 shitposts and get right to the point here.
Do YOU really, *seriously* believe that a cable network is legally obligated to pay billions of dollars for a channel that under 2,000 people actually watch, because the owner of that channel is black?
They are the very reason such a ridiculous demand is plausible. I am very glad it is being made against them.
Bentley Carter
Comcast couldn't be more leashed.
Christian Butler
>THESE WHITE PEOPLE AREN'T WHITE BECAUSE THEIR RELIGION IS DIFFERENT Retarded.
Chase Hall
seeing CNN at 22 makes my day thanks user
Xavier Cooper
CNN has been going through mass layoffs, they are completely on the brink.
Grayson Scott
So Comcast…I understand you're getting older.
Owen Wilson
Fuck, they don't even consider themselves white when it suits them.
Zachary Morales
They've been shit long before Trump. Thankfully Trump is stuffing the SC to put a stop to 9th Circuit's shenanigans, but they still need to be dissolved in the long run as they are obviously acting as political activists from the bench. An absurd abuse of powers. I wonder if Adam McKay will ever make a flashy movie about how corrupt they are starring Steve Carrell
Parker Smith
He looks racist.
Adrian Brooks
I can give a simple apples-to-apples comparison here.
ESPN is widely considered one of the worst networks for a cable provider to deal with, they currently demand a whopping $175 million for access to their 1.9 million loyal regular viewers. Assuming best case scenario that all of these people are ESPN fanatics who would drop their cable service immediately if they could no longer get ESPN, that means Comcast is paying them $92 per viewer per year to do business.
Again, they're the most egregious example. Most networks run much more favorable deals towards the cable company, only receiving $6 or $10 per viewer they provide to the service.
Now, if this lawsuit goes through, instead of $92 for an ESPN viewer, or, say, $8 for a Food Network viewer, Comcast is going to be forced to pay $10,000,000 per Comedy.TV viewer.
OBVIOUSLY NOBODY WOULD BE ON RECORD SAYING ITS ABOUT RACE, WHICH ITS CLEARLY NOT, DISCOVERY WONT DISCOVER SHIT
>YOU MEAN YOU WONT CARRY MY SHIT TIER CHANNELS THAT NOBODY WANTS TO WATCH >DAS RAYCIS! FUNNY THING IS HE MIGHT EVEN GET AWAY WITH IT, ITS THE CURRENT YEAR
Levi Rodriguez
>"In addition to recounting Entertainment Studios' failed negotiations with Charter, Plaintiffs' amended complaint also included direct evidence of racial bias. In one instance, [Charter VP of programming Allan] Singer allegedly approached an African-American protest group outside Charter's headquarters, told them "to get off of welfare," and accused them of looking for a "handout." Plaintiffs asserted that, after informing Charter of these allegations, it announced that Singer was leaving the company. In another alleged instance, Entertainment Studios' owner, Allen, attempted to talk with Charter's CEO, [Tom] Rutledge, at an industry event; Rutledge refused to engage, referring to Allen as "Boy" and telling Allen that he needed to change his behavior. Plaintiffs suggested that these incidents were illustrative of Charter's institutional racism, noting also that the cable operator had historically refused to carry African-American-owned channels and, prior to its merger with Time Warner Cable, had a board of directors composed only of white men. The amended complaint further alleged that Charter's recently pronounced commitments to diversity were merely illusory efforts to placate the Federal Communications Commission (FCC)."
That sounds like a pretty good case to me.
Jaxson Russell
There is a Fox Sports 2?
Jordan Thompson

White is a phenotype you absolute moron, not a race, and not an ethnicity, if you identify as white it means you are a mongrel, a mutt. Whiteness is something you have, nothing more. Pretty much this, just like gypsies, they have are part of a nation.

The Jews are basically the main reason blacks are even a problem.
White is a race. If you don't identify as white, you're a POC of color.
Evan Parker
for a longer answer, discovery allows you to get access to a ton of information from the other side. The court can order them to turn over all of their emails, and you can also depose their employees and former employees.
You'd be surprised what you can find in emails, I'm an attorney and it wouldn't surprise me at all if there were an email basically saying "We shouldn't carry ESN because I don't want any black programs." Former employees will also spill the beans on a lot of things. Current employees usually don't give as much info for obvious reasons, but you can still trap them.
You are a faggot that doesn't know shit about race realism or racial theory. An angry and ignorant little mutt. Caucasian is a race, white is a phenotype and an identity that was developed for poorfag mutt new worlders. Americans unironically think Asian, White and Latino are races.
>jew mutt poster shows his true face fuck off retard
Jordan Brown
Section 1981 of the 1866 Civil Rights Act prohibits racial discrimination in contracts. Traditionally, this means that you have to prove that race was THE factor in getting your contract rejected. A Ninth Circuit panel, though, rejected over a hundred years of caseload and decided that if race could be *A* factor, then that's good enough for a lawsuit. Apparently the Comcast exec referred to Allen as
>you people
And also told him nobody but black people will watch his programming and it's niche even within that demographic. Which is to say that the audience is limited, if Allen were white his channel still would have a narrow audience.
Expect the Supreme Court to overturn this one, but Ginsburg will probably put in a protest vote for the hell of it.
Daniel Clark
remember when Oprah sued someone for saying she was gay? I'm on the lowest tier of cable and I get all the black channels

I'm a current attorney you fucking retard. I literally just did a case against a billion-dollar company with damning emails. There are often 100,000+ emails in these cases, Comcast isn't going to go through it themselves their attorneys do. And the attorneys aren't going to risk losing their license or worse over this. It's not even their attorneys a lot of times, it gets contracted out to doc reviewers who DGAF. Sometimes evidence does get destroyed but a lot of times it doesn't.
>the capslock retard who doesn't understand the legal system is also a /pol/tard ranting about retarded conspiracy theories
Leo Thomas
Point isnt to actually win. The point is to make it so costly for them that it ends up being cheaper to just carry the channels.
You polfags can't be mad. Your lord and savior Trump and used that tactic dozens of times
>tfw no outcome where both parties and sentenced to death

It will never be cheaper to just carry the channels, because it would set a dangerous precedent.

On December 3, 2014 a $10 billion racial discrimination lawsuit was filed against AT&T's U-verse division and DirecTV by the National Association of African American Owned Media (NAAAOM) for allegedly violating the Civil Rights Act of 1866. NAAAOM is headed by Entertainment Studios Vice-President Mark DeVitre. The lawsuit claimed that Entertainment Studio Networks were denied carriage by the two providers on racial concerns.[7] In December 2015, AT&T and DirecTV (by then part of AT&T) reached a settlement with Entertainment Studios to carry the networks, with Comedy and Justice Central carried on DirecTV, and Comedy, Recipe, ES, MyDestination, Cars and Pets added to U-verse, along with Justice Central's existing carriage.[8]
The same type of lawsuit, again for $10 billion, was filed against Charter on January 28, 2016, which seeks carriage as part of Charter's merger with Time Warner Cable and Bright House Networks into the front-facing Spectrum brand.[9][10][11] Charter and Comcast (which had a separate $20 billion suit filed against them by Entertainment Studios and NAAOM) filed an appeal to dismiss the lawsuit in the United States Court of Appeals for the Ninth Circuit on First Amendment grounds, which was dismissed by the 9th Circuit on November 19, 2018, allowing the two suits to go forward to trial

No chance they get away with this obvious scamming. The current SCOTUS is too based and the percent they set will ironically allow racist corporations to get away with actual racism in the future.
