As soon as Todd killed the kid I would've killed Todd.
First off, that kid has no idea what the fuck is going on. He just sees a bunch of adults doing some work on a stopped train. There's zero reason to suspect the kid would even think about them for a minute once they were out of sight. Second, even if the kid somehow did know they were doing something illegal, there's almost no chance he could give their description to the police beyond "three white guys aged 20-50". Third, even if there was a good chance of being caught, they traded 0 time served to like a few months to 2 years tops for 0 time served to 25+, and cops are going to devote way more time to investigating a missing child/murder than to "three guys pouring water into a chemical tank".
As soon as Todd pulled the trigger he signed his own death warrant. Jesse and Walt should have killed him as soon as possible. Right there if possible, leave his body there with the gun so the cops can guess some psycho member of this crew shot a kid and was immediately killed by his partners.
