So about that Epic Stone Group v Twentieth Century Fox case. Anyone here want to know where it stands?
The only thing that happened is that on March 28th, the court clerks entered a notice saying that they've failed to summon the defendant (Fox), because the summoned party didn't match the party in the complaint. I don't know if this is because of the Fox-Disney merger, or because the plaintiff messed it up somehow.
According to a scheduling order, the parties had until today (if using the non-expedited schedule) to file an interim status report. No such report has been filed on the docket.
If I get time tomorrow, I'm going to check if Fox has filed a trademark cancellation with the USPTO. Epic Stone group's omnibus trademark registration for "Battle Angel" wasn't published for opposition until March 26, 2019 - even if it was filed for in 2018. Even if they did file a mark in 2012, that was only for action figures - and even that might be a losing proposition.
My guess is that the case was abandoned as hopeless. There's been no dispositive motions filed, but as long as they fail to even summon Fox into court, Fox doesn't have to file anything yet.
