It wasn't the same time or situation. It was some of the same people and got tense because cap wasn't expected to be there then gave a controversial order to get the case with the stone. Hence the "flashback" aspect, at least for cap and the audience.

Cap needed to realise doing whatever the fuck they want has meant a lot of collateral damage that the government can't just let slide anymore
If they could have negotiated the terms of the Accords, shit would have gone a lot smoother, but both characters are too stubborn to compromise

The accords were retarded though, and so was the situation that led to them. It was 100% Tony's fault for making Ultron in the first place, and the collateral damage from other shit that The Avengers did was really just incidental to stop an external threat.

The whole New York scene was filled with meaningless fanservice, so it's the writers who were in the wrong here.
Cap seemed so underpowered in the movies compared to the comic (just from the panels I've seen, I don't read them myself). I know he's just supposed to be "peak human", but he never seemed that much more powerful than the average trained fighter in the films.
