Because if the seagulls are eating the injured penguin, they aren't trying to eat any of the other healthy penguins.
Sick, injured, young, old and infirm animals are typical prey in the wild. Healthy adult animals are less likely to get eaten.
Because animals are just like the Chinese: they have no concern or empathy for the lives of well-being of their fellow kind

Some animals (dolphins, elephants, ravens) have been seen to grieve.

Corvids, dolphins, great apes and elephants, I think, are sapient animals, so yes.
This is not their final form yet. They are still transitioning from land animal to fully aquatic. It's like how whale's ancestors transitioned to become sea-living creatures.
Penguins' final form will be like Ichthyosaurs. Then all animals that bully them now like Orcas will regret it.

I'm not sure how intelligent penguins are, but birds are generally pretty intelligent so it probably has some kind of sadness for its fellow being ripped apart.
Petrel wouldn't fuck with a healthy penguin that can put up a fight when it can easily just pick apart the injured penguin right in front of it.
It's kind of like when you see a hyena getting really close to a group of feeding lions and you're like "wow, that hyena's really close". It knows the lions are too preoccupied with eating to really chase after it, and it knows the lions would rather prefer to just eat what they already hunted rather than expend calories trying to catch a wily hyena.
Animals are pretty predictable. They more or less all think the same, generally speaking.
