Plagiarism isn't illegal. Academic plagiarism has a very strict standard, but doesn't apply to movies. Copyright Infringement on the other hand is much more forgiving and there are many cases where obviously stolen ideas either don't violate copyright or the odds of winning a lawsuit are just too slim to be worth pursuing.
