This kind of crime would leave next to no evidence and since the body or living kid is never found you can do shit about it.

So yeah, I'm pretty sure they were at least involved. I think the Portuguese detective was probably right. The parents had gone out and left their children unattended in their beds. Madeleine probably woke up and tried to look for them and had some kind of fall/accident. Possibly falling off the sofa and hitting her head. The parents then panicked and knew they'd be done for neglect and so covered the whole thing up.
