Prosecutors don't see it as worth pursuing.
1. There's no real victims in this crime. No innocent men actually went to jail over this. You could say "well he wasted the police's time" and yeah, that's true, but now you'd be wasting court time on top of it. Sunk cost fallacy.
2. There's no way he'll ever actually repeat this crime and get be successful. If he tries to fake another hate crime, basically no one will believe him, and it'll be so intensely scrutinized. He knows this so well he'll never try, which achieves the same goal as locking him up.
3. Tying back to number one, they have more important criminal cases to pursue. There are violent crimes with actual victims that exist, and the courts have a finite amount of time and resources.
That said, as high profile as the case was, they're dumb not to pursue it. It makes them look incompetent and corrupt otherwise.
