Yes, he is an evil Kriptonian. Technically, astronaut Ultraman was from the Anti-Matter Earth, not Earth-3.

For a while people thought Anti-Matter Earth had been retconned, but Morrison has an Anti-Matter Hal in his GL book right now.

Yes, he should, and Earth-3 also should be currently a big crater due to the Anti-Monitor destroying most of it, but Bendis can't into continuity. He picks and chooses what counts for his stories.

Although to be fair, Jonhs blowing up Earth-3's in its first appearance was extremely short sighed. I'm all for retconning that.
