In the real world, that mindset works, because most criminals (unless they're rich and have connections, but that doesn't apply to most criminals) go to jail and stay in jail once they're caught. We don't have a problem with insane clown mass murderers constantly escaping and racking up quadruple digit body counts.

Plenty of cases where that makes sense. It's when the hero knows the vilain will have killed hundreds of people by next week and still doesn't kill the villain, that it gets bad.
