In theory the Empire----the actual Empire---should be around (or at least the movies have not confirmed its fate by TFA), but it's narrative irrelevant and confined to the Core Worlds even if its people are alive and it's technically still a thing. The movies still treat it as if its dead/an afterthought/impotent thanks shit like the Galactic Concordance(or the destruction of the NR's leaders in TFA, reconnected to the ENTIRETY OF THE NR in TLJ.)

The FO was launching multiple simultaneous planetary invasions and was able to pull of a ground assault larger than Hoth in the immediate aftermath of having their flagship crippled, it's support fleet destroyed, and their leader killed. The Resistance consisted of 20 guys on a freighter by the end of TLJ. The only explanation that would actually work is that the FO reached maximum capacity for invasion and occupation and the whole thing has turned into a medium-intensity conflict in FO-occupied territory between a stretched thin FO and rallied NR reserve forces.
