At best it's more about "A single person can't decide whether it's justified to take the life of a man" bullshit that simply goes to far at times with how extreme comics have gone at time went on.

Concentrated effort by the Gotham legal system. What would Batman do without his villains, fight muggers and mobsters? Batman is probably also a huge tourism draw.

It mainly just comes down to whether or not it’s justified to take life into your hands justified combined with the question on why Batman is literally the only person in all of Gotham who should kill him. There’s also the fact that when put in a trolley situation, he always abandons the lever to try and stop the trolley. The biggest issue is that over the years, there has literally been millions who have died from

arcs and arcs where the joker nukes Gotham or some shit. The Punisher runs into a different issue of higher-ups not wanting to part with characters so nobody actually interesting stays dead. You also get situations like how Batfleck for some reason hasn’t killed Will Smith or the hot topic couple.
