Kingpin was actually part of the Spider-Man initiative. He killed prowler so Miles could have his uncle Ben moment.

Prowler obviously was caught in dramatic moment timing, so Fisk took the shot and killed him to speed things back up.

The real question is, how did Miles's Dad not see the guy the size of the Kaaba standing outside and think spiderman shot him for some reason.

We never see his original reaction to Prowler failing to find Miles, but I doubt he wasn't happy. Then Prowler again fails to catch Miles a second time, but follows him back to the Spider People.

Then Prowler has the kid he's chasing literally in hand and decides not to kill him.

Undoubtedly, Fisk figured that Aaron was trying to double cross him somehow and intentionally letting Miles get away.

Because not everyone knew Kingpin was a villain. It seemed pretty much shown that in the public eye Kingpin was viewed as a simple business man.
