Legally its generally argued as being protected under the satire and parody clauses of copyright. Realistically, the people who made Evangelion just don't have enough time to go after every NGE reference in media so they just let it go. Unless the product is directly competing with them, the creators usually appreciate the homage, because in cases like this its basically free advertisement ( "oh look, Asuka and Rei, I remember them, I should go watch Evangelion again" etc etc).

God, whenever I hear/read "Marvel" and "Manga" in the same sentence, my mind defaults to the Mangaverse run back in the early 2000's.
Like... there was no denying it was a blatant fucking cashgrab meant to capitalize on the anime boom of that time, but it had some legit cool interpretations of a lot of characters, like Mangaverse Spider-Man being one of the few surviving members of a clan of mystical spider-themed ninja that were basically wiped out by a vengeful former member empowered by dark magic.
Too bad the entire fucking run was nothing but wasted potential, poor writing, and disgusting "How to Draw Manga" tier art.

Q. Hayashida did a manga that ended fairly recently called Dorohedoro and has another one running right now I haven't checked out called Dai Dark. Dorohedoro at least was superb, a bizarre and comedic gritty looking manga. It looks a lot like this cover she did for Ant-Man, so it looked like a weird horror manga, and the plot was frequently horrific, but all the characters were oddly jovial and casual about everything. Worth checking out for Yea Forumsmrades who don't usually read manga.

it makes me wonder where western comics would be if we were friendlier to 'fan works'. i think a lot of the appeal for overwatch, 40k, etc comes from people sharing fan art.
the doujinshi system is a bit different, with the artists actually getting paid for their work, but it's not a whole lot of money and it certainly doesn't outweigh the benefit of having free, unique, user relevant advertising.
it is also a cheap way to identify new artists who are interested to work in the industry.
