Or specifically, we don't see him by himself fight the tripods, but we do see an army that has him, the martians, Gulliver Jones, and others trying to fight off the tripods. But it's pretty brief.

every artist, especially cover artists draw them different sizes. But I guess you are right, this artist draws them a little smaller than most, still sexy, and they state classic costume

No, they can. They got the rights a while back, but before that they were only doing a comic called Warlord of Mars without mentioning John Carter on the cover.

My favorite part of John Carter is that the weirdest shit happens in the first chapter before he gets to Mars, like how he is immortal and his inexplicable teleportation.

Some of the original John Carter books are public domain (at least, the early ones), but the names of all the characters are trademarked by the estate of Edgar Rice Burroughs. To work around this, Dynamite never had the name "John Carter" anywhere on their promotional material, and kept it inside the comics (doing the same with their Tarzan series, calling it "Lord of The Jungle"). The Burroughs Estate found out about this and sued Dynamite for Trademark Infringement (not Copyright Infringement). After this, Dynamite made a deal with the Burroughs Estate: they could still continue using the Barsoom and Tarzan characters and publish comics, except now the Estate had to approve everything.

God I hate the Burroughs Estate, they are so fucking scummy. The guys been dead for ages and they still milk everything out and prevent other people from doing good stuff with stuff that should be allowed in public domain

On one hand, I agree with that sentiment, but on the other, they still owned the rights to several John Carter and Tarzan novels that Dynamite could have used characters and concepts from if they had gone to the estate in the first place. Marvel did John Carter and Tarzan 40 years earlier and they didn't have any trouble because they went through the estate.

should should still have the rights to publish and sell all the old books, I'm not denying that and if anyone wants to translate those to comics they should go through the estate. However, he is a public domain character and there is NO REASON to have to ask their permission to use the character or name, that's what the public domain is supposed to mean
